Terms and conditions

The products on sale on www.taskaofficial.pl (hereinafter the "Site") are sold and invoiced by GIA.MAU' RETAIL srl, with registered office in VIA GORIZIA 115 - 76123 ANDRIA (BT) - P.IVA 07210910720. GENERAL CONDITIONS OF SALE

  1. Acceptance of the general terms and conditions of sale and conclusion of the contract

    1.1 The contract stipulated between GIA.MAU' RETAIL S.R.L. (hereafter "Taska Official") and the Customer (i.e. the subject, natural person, who makes the purchase on the Site, not related to his own commercial, entrepreneurial or professional activity) has to be considered concluded with the acceptance, even if only partial, of the order by Taska Official. In case of non-acceptance of the order, Taska Official will provide to give timely notice to the customer.

1.2 By placing an order in the various ways provided, according to the order form on the Site (hereinafter the "Order"), the Customer declares that he/she has read all the information provided to him/her during the purchase process and fully accepts these general conditions (hereinafter the "Conditions").

1.3 These Conditions may be printed or saved on a durable medium, in accordance with the provisions of Article 12 of Legislative Decree 70/2003 and Article 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

  1. Purchasing methods

2.1 The products offered for sale by Taska Official are only those present on the taskaofficial.pl website at the time of placing the Order, as described in the relevant information sheets.

2.2 It is in any case understood that the images accompanying the description of a product are for information purposes only and may not be perfectly representative of its characteristics but may differ, for example, in colour and size (also due to the browser and monitor used to access the Site and view the images).

2.3 In order to place an Order, the Customer has to fill in every part of the form on the Site and send it after having carefully read the Conditions, as well as the characteristics of the product and/or of the products he wants to buy. The Customer must also ask Taska Official, if he wants, to issue a fiscal invoice for the purchase, according to the art. 22 D.p.R. n. 633/1972.

2.4 The correct receipt of the Order is confirmed by Taska Official through an e-mail reply, sent to the e-mail address communicated by the Customer. This confirmation message will briefly report the purchase conditions, as provided for by the applicable law, as well as the data entered in the Order by the Customer, so that the latter can verify them and eventually communicate without delay the necessary corrections of incorrect data.

  1. Prices and Methods of Payment

    3.1 The prices indicated on the site are inclusive of taxes and VAT. Any shipping costs or payment charges are in any case communicated to the Customer in advance via the site or these Conditions.

3.2 The following payment methods are available:

(i) PayPal
The customer may use the Paypal circuit for payment in accordance with its specific terms.
(ii) Credit Card
In case of purchase of goods with Credit Card payment method, the transaction can take place through the Paypal secure server or another secure server chosen by Taska Official.
In no case and in no phase of the payment Taska Official will be able to know the information related to the credit card of the Customer, transmitted through a protected connection directly to the site of the bank that manages the transaction. No computer file of Taska Official will store these data and therefore in no case Taska Official will be responsible for the possible fraudulent and undue use of credit cards by third parties during the payment.
(iii) Bank transfer
In case of purchase by bank transfer, the bank details for the payment will be displayed. The goods will only be dispatched upon receipt of the actual payment at the bank.
(iiii) Cash on delivery (Italy only)
In case of cash on delivery, payment must be made exclusively in cash upon delivery of the purchased products.

  1. Delivery of products and related costs

4.1 The purchased products will be delivered to the address indicated by the Customer in the Order within 24-72 hours from the acceptance of the Order by Taska Official, at the cost specifically indicated on the Site before sending the Order. Taska Official reserves the right to accept or not deliveries requested outside the Italian or European borders. In any case, for deliveries to be made outside the Italian borders, the shipping costs and the delivery times could vary.

4.2 With regard to deliveries requested in countries outside the European Union, any customs import costs shall be borne by the consignee. We therefore invite the Customer to contact the customs authorities of his country in advance to check the costs and any import limits.

4.3 The delivery times indicated by Taska Official must be considered as purely indicative and a delay in respect to them, or the possible delivery made with subsequent split shipments, do not entitle the Customer to refuse the delivery and to ask for compensation or indemnity.

4.4 Upon delivery of the products, the Customer is required to check
that the number of packages delivered corresponds to that indicated in the transport document.
that the packaging is intact, not damaged, not wet or in any case altered, including the closing materials (adhesive tape or metal straps).

Any damage to the packaging and/or to the product or the mismatch in the number of packages or indications must be immediately detected, with a specific indication on the delivery document of the product to be returned to the courier.
Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, in accordance with the procedures set out in this document.

5. Right of withdrawal

5.1 Pursuant to Article 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to give reasons and without any penalty, within 14 (fourteen) working days from the date of receipt of the products.

5.2 In order to exercise the right of withdrawal referred to in the previous article 5.1, the Client must send to Taska Official a communication to that effect, within the indicated terms, to the following email address info@dggroupsrl.it.

5.3 In case of withdrawal the Customer will be able to send back the products to Taska Official free of charge within 14 (fourteen) days from the withdrawal itself, at the following address GIA.MAU' RETAIL S.R.L., located in VIA GORIZIA 115 - 76123 ANDRIA (BT). The goods must be returned intact, complete with all its parts and in their original packaging (envelopes and packages), kept and possibly used for the time strictly necessary to establish and verify the nature, characteristics and size, according to normal diligence, without any signs of wear or dirt, in compliance with the conditions set out below:

The right of withdrawal shall not apply to products for which the customer has requested customisation.

the right of withdrawal may apply to the product purchased in its entirety; it is not possible to exercise the right of withdrawal only on part of the product purchased (e.g. accessories, complements, etc.);
for withdrawal to be possible, the product must be undamaged and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: labels, tags, seals, etc. ...);

in case of damage of the good during the transport, Taska Official will communicate it to the customer, to allow him to file a timely complaint against the courier chosen by him and to obtain the relative refund; the product will then be made available to the customer, simultaneously cancelling the request for withdrawal;
Taska Official will not answer in any way for damage, theft, loss occurred during or anyway in dependence of the shipment for the return.

5.4 Taska Official will refund the Customer the entire amount already paid, net of any additional shipping costs according to art. 56, paragraph 2, of the D. lgs. 21/14), within 14 (fourteen) days from the withdrawal, through a transfer procedure of the charged amount, using the same means of payment used by the Customer for the initial transaction, unless otherwise agreed. In any case, the Customer will not bear any cost as a consequence of this refund. Taska Official can suspend the refund until the receipt of the returned product or until the moment in which the customer demonstrates to have correctly sent back the product, if previous.

5.5 In any case, the Customer will lose the right of withdrawal in the cases in which Taska Official ascertains that
the returned product and/or its accessories, and/or its packaging are not intact;
the product is missing its external packaging and/or its original internal packaging;
the product is missing of integral elements of the same and/or accessories (e.g. fasteners, laces, buckles, etc.).
In case of forfeiture of the right of withdrawal, Taska Official will provide to return the purchased product to the sender, charging him the shipping costs and, if already refunded, the price of the product.

  1. Guarantees

    6.1 All the products sold by Taska Official are covered by a 24 (twenty-four) months warranty for conformity defects, according to Title III of the Legislative Decree 206/2005. In order to benefit from the assistance under warranty, the Customer must keep the invoice, or the payment receipt, together with the transport document.

6.2 The guarantee for conformity defects shall apply provided that the respective product has been used correctly, in accordance with its intended use and with the instructions for use and washing in and/or with the product.

6.3 If, for any reason, Taska Official is not able to return to the Customer a product under warranty (repaired or replaced), or if the repair or the replacement are, also due to the value of the product, excessively expensive, Taska Official can proceed to the reasonable reduction of the price paid, or to the restitution of the whole amount paid with termination of the contract.

6.4 In cases where the application of the warranties provides for the return of the product, the same must be returned by the Customer in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment).

  1. Complaints and information requests

8. Privacy

8.1 The personal data collected by placing the Order will be processed by Taska Official only in order to satisfy the express requests of the Customer, in compliance with the European Regulation 679/2016 and with the privacy policy on the website. Any further processing will be done only with the express consent of the Customer.

9. Applicable law

9.1 The contract of sale referred to in these Conditions and its execution shall be governed by Italian law, with the disapplication of the conflict of laws rules and the United Nations Convention for the International Sale of Goods. The Court of the Customer's municipality of residence shall be competent for the solution of the relevant disputes.
